The Canadian judiciary has become quite chintzy when it comes to awarding dangerous offender designations.
Oh, the odd scuzzbucket still gets the tag, but it’s far from the halcyon days of 2018 when 60 criminals were deemed dangerous offenders.
That’s as tough as it gets in this country and essentially means you are caged at His Majesty’s Leisure. But over the past six or seven years, that number has plummeted to just 20 or 30 making the dean’s list of depravity.
More than a decade of Justin Trudeau and his soft-on-crime minions has put the dangerous offender designation on the endangered list.
‘Pattern of persistent aggressive behaviour’
And maybe that’s what career criminal James Brown, 41, hoped for as his useless life once again circled the drain. Justice Joseph Perfetto, however, thought otherwise. Oddly, he was a Trudeau pick.
On Friday, Perfetto noted that the St. Thomas man had an eye-popping 61 prior convictions.
“There is a pattern of persistent aggressive behaviour by Mr. Brown … he is and will remain to be a substantial threat,” the judge said.
“I find that there is no reasonable expectation that a lesser measure other than an indeterminate sentence will protect the public. I sentence James Brown to a sentence of detention in a penitentiary for an indeterminate period … Mr. Brown will be designated to be a dangerous offender.”
Victim left paralyzed from chest down
James Brown’s (not THAT James Brown) latest and greatest legal encounter stemmed from an incident on May 16, 2023 when he heartlessly shot his then 27-year-old girlfriend, Paige Havell, three times in the back at her St. Thomas apartment. The shooting paralyzed Havell from the chest down.
For good measure, Brown shot and killed Havell’s dog.
It emerged that the shooting was the result of a domestic dispute that spiralled out of control.
Brown, being a bear of little brain, was quickly nabbed by cops, arrested and charged. A jury would find him guilty of discharging a firearm with intent to wound.
As for Havell, life as she once knew it is over. She resides in a long-term care facility and needs assistance.
“Now that James has been designated a dangerous offender, I feel relief and hopefully nothing else happens to anyone else. Now I can move on with my life,” Havell told reporters outside the grand old St. Thomas courthouse.
Havell has a truckload of worries. One of them will not be the hyper-violent James Brown, who reportedly looked like the dangerous offender from central casting being escorted into court in handcuffs and leg irons.
Brown will have company — though not enough — in the 900-plus other dangerous offenders in this country. A dangerous offender tag means you’re going away and probably never coming out unless it’s in a pine box.
Throw away the keys
Every day, Canadians are outraged at killers and violent criminals getting a slap on the wrist. We watch in horror as activist judges bend themselves into pretzels looking to excuse the worst behaviours known to humanity.
Victims like Paige Havell are seldom part of their equation.
Maybe if more judges — and Crown attorneys — revved up the dangerous offender designation for the deserving, our judiciary and justice system as a whole would get a lot less grief. Canadians might even sleep easier.
